Terms and Conditions

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts between the Escape Readz World Köhler GbR (hereinafter referred to as the „Provider“) and consumers (hereinafter referred to as the „Customer“) regarding the use of the subscription-based book flat rate and the planned purchase of merchandise from the Provider’s online shop.

1.2 Deviating terms and conditions of the customer are not recognised unless expressly agreed to by the supplier.

1.3 Consumers are natural persons who conclude a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity (§ 13 of the German Civil Code (BGB)).

1.4 Concluding a contract with businesses within the meaning of § 14 BGB is excluded.

1.5 The provider's offer is exclusively aimed at natural persons of full legal capacity who Reached the age of 18 to have.

2. Conclusion of Contract

2.1 The services presented in the online shop (flat-rate subscriptions) do not constitute binding offers, but serve as an invitation for the customer to submit an offer.

3. Right of withdrawal

4. Prices and payment terms

4.2 Die Zahlungsabwicklung erfolgt über den externen Zahlungsdienstleister Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Niederlande (z. B. für Kreditkarte, SEPA-Lastschrift, SOFORT Überweisung oder andere über Mollie angebotene Zahlungsmethoden).

4.3 Die Zahlungsabwicklung erfolgt ausschließlich über die technischen Systeme von Mollie. Die Escape Readz World Köhler GbR hat keinen Einfluss auf Art, Umfang und Zweck der dortigen Datenverarbeitung. Es gelten die Geschäfts- und Datenschutzbestimmungen von Mollie (abrufbar unter mollie.com).

4.4 Bei Zahlung per SEPA-Lastschrift oder anderen lastschriftbasierten Verfahren verpflichtet sich der Kunde, für eine ausreichende Kontodeckung zu sorgen. Rücklastschriften, die auf mangelnde Deckung oder falsche Angaben zurückzuführen sind, berechtigen den Anbieter, die entstandenen Rücklastschriftkosten und Bankgebühren an den Kunden weiterzugeben.

4.5 Besteht der begründete Verdacht eines Betrugsversuchs, ist der Anbieter berechtigt, die im Rahmen der Bestellung erhobenen Daten (einschließlich IP-Adresse) an Strafverfolgungsbehörden zu übermitteln.

4.6 Der Anbieter ist berechtigt, die Preise für zukünftige Abrechnungszeiträume oder Abonnements anzupassen, sofern unvorhergesehene, nach Vertragsschluss eintretende Kostenerhöhungen (z. B. Steigerungen der Server- und Infrastrukturkosten, allgemeine Betriebskosten oder gesetzliche Änderungen) oder eine wesentliche Weiterentwicklung und Vergrößerung des Angebots (insbesondere des zur Verfügung gestellten Buch- und Medienbestands im Verhältnis zur Nutzerbasis) dies erfordern. Preisanpassungen werden dem Kunden mindestens sechs Wochen vor ihrem Inkrafttreten in Textform (z. B. per E-Mail) mitgeteilt. Im Falle einer Preiserhöhung steht dem Kunden ein Sonderkündigungsrecht zum Zeitpunkt des Wirksamwerdens der Änderung zu; macht der Kunde von diesem Recht keinen Gebrauch, gilt die Änderung als genehmigt. Hierauf wird der Anbieter in der Änderungsmitteilung nochmals gesondert hinweisen.

5. Subscriptions and Durations

5.1 The flat rate is offered as part of a subscription model. Billing is carried out monthly, quarterly, semi-annually, or annually in advance, depending on the customer's choice.

5.2 The subscription will automatically renew for the chosen period unless cancelled before the end of the current billing period. Cancellation can be made at any time at the end of the term in your customer account or in text form.

5.3 A pro-rata refund of subscription fees already paid for early termination or non-use will not be issued.

6. Provision and Rights of Use

6.1 The content of the flat rate is provided exclusively digitally via online access via the provider's platform. The customer is responsible for meeting the technical requirements (end device, internet connection).

6.2 The Provider grants the Customer a simple, non-transferable right to use the content provided for private purposes during the term of the subscription.

6.3 The specific are also applicable Terms of Service for Book Flat Rate (particularly the restriction to personal end devices and the strict prohibition of account sharing and copy protection circumventions).

7. Special Note Regarding Merchandise (Spreadshirt)

7.1 The sale of merchandise items is carried out using the so-called print-on-demand method via an external provider Spreadshirt (sprd.net AG).

7.2 When ordering merchandise, Escape Readz World Köhler GbR will not be a contracting party to the customer. The General Terms and Conditions and policies of Spreadshirt exclusively apply to the production, delivery, revocation and warranty of merchandise items.

8. Warranty and Liability

8.1 Statutory warranty rights for digital products and services apply.

8.2 The provider is fully liable in cases of intent, gross negligence, and injury to life, body, or health. In cases of simple negligence, the provider is only liable for breach of essential contractual obligations (cardinal obligations) and is limited to the foreseeable, contract-typical damage.

9. Applicable Law and Dispute Resolution

9.1 German law shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
